§ 1 Scope

These General Terms and Conditions (hereinafter "Terms") of Arens & Gerstner GbR, trading as "Sparkane" (hereinafter "Provider"), apply to all contracts for digital products and associated digital services (hereinafter "Products") that a consumer (hereinafter "Customer") concludes with the Provider regarding the Products presented in the Provider's online store.

This offer is exclusively directed at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Contracts with entrepreneurs are not concluded.

Digital content within the meaning of these Terms are all data not located on a physical data carrier that are produced in digital form and provided by the Provider under certain usage rights regulated in more detail in these Terms.

§ 3 Conclusion of Contract

The presentation of Products in the online shop does not constitute a legally binding offer, but a non-binding online catalog. By submitting an order, the Customer acknowledges these Terms as solely authoritative for the legal relationship with the Provider and submits a binding order for the selected Product.

The contract is concluded upon confirmed successful payment and acceptance of the order by the Provider. Stripe processes payment and is not the seller.

Before payment, you can review and correct your details and the selected Minecraft player. Merely requesting or creating a payment does not constitute acceptance of the order.

§ 4 Contract Language

The languages available for the conclusion of the contract are German and English.

§ 5 Contract Text

The contract documents and order details applicable at checkout are saved and confirmed to the buyer by email. Assigned purchases and saved contract documents can be retrieved under “My purchases” after signing in with the buyer email. The currently published texts do not replace saved versions from an earlier purchase.

§ 6 Delivery Conditions

Delivery of digital content takes place after receipt of payment by the Provider. The purchased ranks and tags are usually activated on the Minecraft server automatically within a short time. In exceptional cases, activation may be delayed due to technical reasons. The activation is linked to the Minecraft UUID (Universal Unique Identifier) provided by the Customer during the order process. The Customer does not need to be online on the server for the activation.

§ 7 Payment Conditions

Payment of the purchase price is due upon conclusion of the contract.

§ 8 Prices

As a small business within the meaning of § 19 para. 1 UStG (German law), no value added tax is charged.

§ 9 Digital Content

The subject of the contract is the purchase of digital content for the Minecraft server "Sparkane". This includes:

  • Ranks: Permanent player ranks with various in-game benefits
  • Tags: Cosmetic chat tags for personalization

The Customer does not acquire any intellectual property rights to the digital content. All purchases are linked to the player's Minecraft UUID and are non-transferable.

The Customer is responsible for proper use. Appropriate access restrictions may apply following violations of the server rules. The Customer’s statutory rights remain unaffected.

Ranks apply for the duration of operation of the Sparkane network. We may develop and improve the service. For materially adverse changes, closure of a game mode, or changes required for legal reasons, we inform affected buyers by email and comply with statutory information duties and remedies. Statutory rights, including those concerning failures to perform, also remain in place in the event of bans or closure of the network.

§ 10 Right of Withdrawal

The Customer has the statutory right of withdrawal as described in the Withdrawal Policy.

§ 11 Warranty

The Customer's warranty rights are governed by general statutory provisions unless otherwise specified below.

We guarantee that the purchased digital content functions properly on the Minecraft server. For technical issues, please contact our support via email or Discord.

A guarantee is not provided by the Provider.

§ 12 Liability

Claims for damages by the Customer are excluded unless otherwise specified below. This exclusion of liability also applies in favor of the Provider's legal representatives and agents if the Customer asserts claims against them.

Excluded from this liability exclusion are claims for damages arising from injury to life, body, or health, as well as claims for damages arising from the breach of essential contractual obligations. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.

Also excluded from the liability exclusion is liability for damages based on intentional or grossly negligent breach of duty by the Provider, their legal representatives, or agents.

§ 13 Applicable Law

The law of the Federal Republic of Germany applies to the contractual relationships between the Customer and the Provider. Excluded from this choice of law are the mandatory consumer protection provisions of the country in which the Customer has their habitual residence.

The application of UN sales law is excluded.

§ 14 Jurisdiction

The place of jurisdiction for all disputes arising from the contractual relationship between the Customer and the Provider is Munich, Germany, provided that the Customer is a merchant, a legal entity under public law, or a special fund under public law.

§ 15 Alternative Dispute Resolution

The Provider is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
